Terms of Use:
These are the terms and conditions, which are legally binding for the use of GodFilms.com and products purchased from GodFilms.
Ownership:
GodFilms.com is owned and operated by GBOD. All content included on our site is owned by GBOD. The “previews” and “trailers” of digital media MAY be downloaded, copied or shared but MAY NOT be sold. The “downloaded short films” MAY NOT be copied, shared or sold.
You acknowledge that GodFilms owns all right, title and interest, including without limitation all Intellectual Property Rights, in and to the Products, and that You WILL NOT acquire any right, title, or interest in or to the Products except as expressly set forth under these conditions. You WILL NOT modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive original media from any GodFilms products, or create or attempt to create a substitute or similar product through use of the Product or proprietary information related thereto. You WILL NOT remove, obscure, or alter GodFilms’ copyright notice, Brand Features, or other proprietary rights notices affixed to or contained within any GodFilms products.
Grant of License:
DOWNLOAD FOR PERSONAL USE (low-resolution license) – The short films are intended for use with individuals. This is a single entity, exclusive, non-transferable license, meaning You, the sole purchaser, are the exclusive owner of this license and may transfer the Digital Media Files between personal computers, iPods, and other media viewing sources for personal use, but public or large scale viewing (of 3 people or more) is strictly forbidden. You MAY NOT post the film on your website or other Internet websites (Youtube, Godtube, Facebook, MySpace, etc.).
DOWNLOAD FOR CHURCH OR GROUP USE (SD, HD License) – The short films are for use in front of groups larger than 3 people, including congregations and youth groups. This is a single entity, multi-exclusive, non-transferable license, meaning only persons associated with the purchasing organization, ministry or church in a single site or location, including You, whether employees or contractors, may have access to project. You MAY NOT make copies of the film, resell the media, share the content outside your organization or group, reedit or alter the contents, post to your website or any other Internet website, or show in a televised broadcast.
General Use:
The Digital Media Files and DVDs MAY NOT be incorporated into a derivative work such as video(s), multimedia work, advertisement, live performance, Internet website, presentation or print project. The Digital Media Files MAY NOT be used for feature films/videos, documentaries, direct to video, or broadcast; Nor may Digital Media Files be screened without express permission from GodFilms.com except where specified under “Grant of License.” The Digital Media Files MAY NOT be sold.
Restrictions on Products for Resale:
The Digital and DVD Short Films and any derivative work thereof MAY NOT, in whole or in part, be used, sold, sublicensed, reproduced, distributed, displayed, incorporated into or otherwise made available as templates, standalone backgrounds, stock elements, effects imagery elements or downloadable files. The Digital Short Films and any derivative work thereof MAY NOT, in whole or in part, be included in any other clip media/stock product, library, collection, or set of clips for distribution or resale. These Restrictions apply even if the Digital Short Films have been significantly altered.
Additionally, you agree to notify GodFilms in writing and take all steps possible to prevent any third party from duplicating or distributing any of the Digital Short Films included in the finished work. Please note that special licensing to obtain additional rights is available by contacting GodFilms at info@GodFilms.com.
Indemnity:
You agree to indemnify and hold GBOD, its licensors, and their officers, directors, agents and employees, harmless from and against any claims, demands, losses, damages, liabilities or expenses of any kind arising from your use of the Digital Media Files and DVDs in any form, any breach of the terms and conditions of this Agreement, or your negligent act, omission or willful misconduct.
Term and Termination:
This Agreement shall be effective as of the earliest of the date you download, install or use, the Digital or DVD Short Film and shall continue in effect for all of eternity. This Agreement is non transferable and is only granted to you and any church, or organization you may have purchased the content on behalf of.
Warranty & Return Policy:
GBOD warrants the Digital Media Files and DVDs to be free from defects in material and workmanship. If we can’t resolve and issue within 36 hours, we’ll refund your money. Otherwise, all sales are final. GODFILMS MAKES NO OTHER WARRANTIES OR REPRESENTATIONS WITH REGARD TO THE DIGITAL MEDIA FILES.
